Effective December 31, 2008, the Law Society of Upper Canada is introducing new Know Your Client (KYC) rules that all lawyers in Ontario will be required to follow. The objective of introducing new KYC rules is to combat increased amounts of fraudulent activity that has been targeting lawyers and their practices and to protect the public from the same fraudsters.

Under the new KYC rules, lawyers are now required to obtain and retain information that confirms the identity of their clients. This requirement applies to clients that are individuals or business entities such as partnerships or corporations. Protecting the confidentiality of this information once it is obtained and respecting the purpose for which it was collected is an important responsibility in our office.

As a result of public concern with real estate fraud, the Ontario government and the Law Society of Upper Canada adopted new rules in 2008 that impose additional requirements on lawyers that practice real estate and, in the vast majority of property sales/purchases, requires that the vendors and purchasers each have a different lawyer.
